Terms and Conditions

Introduction

ogMenu (the "Platform", operated by PISHYS SERV) is a digital menu, QR-code table ordering, and payments platform for restaurants and other food/drink venues (each a "Store"). These Terms govern your access to and use of ogmenu.com (the "Website"), whether you're a Store Owner, a member of Store staff, or a customer placing an order.

By creating an account, connecting a Store, accepting a staff invitation, or placing an order through the Website, you agree to be bound by these Terms and our Privacy Policy.

If you're registering a Store Owner or staff account, you represent that you are at least 18 years old and, if acting on behalf of a restaurant or business, that you have the authority to bind that business to these Terms.

We may update these Terms from time to time; changes take effect once posted on the Website. If you have questions, reach us via the Contact page.

Definitions
  • Store - a restaurant or venue registered on the Platform by a Store Owner.
  • Store Owner - the account that created a Store; has full access, including payment settings.
  • Staff - accounts a Store Owner (or a Manager) invites to help run a Store, with either "Manager" access (menu, locations, orders, and inviting further staff) or "Staff" access (order handling only). Staff accounts never have access to a Store's payment settings.
  • Location - a physical ordering point within a Store (a table, room, counter, etc.), each with its own QR code.
  • Customer - anyone who scans a Location's QR code and places an Order. Placing an Order does not require creating an account.
  • Order - a purchase of menu items placed by a Customer at a specific Location.
  • Connected Account - the Store Owner's own Stripe account, connected to the Platform so the Store can receive payouts directly from Stripe.
Accounts, Store Owners & Staff

Registration Creating a Store Owner account requires an email address and password. You agree to provide accurate information and to keep your credentials confidential. You're responsible for all activity under your account.

Staff Accounts A Store Owner (or a Manager, for the Staff role only) may invite other people to help run a Store by email. Accepting an invitation creates or links an ogMenu account for that person, scoped to the specific Store and role (Manager or Staff) they were invited as. Only the Store Owner can grant or remove Manager-level access; payment settings and Store deletion are never available to Managers or Staff, regardless of role.

Removing Access A Store Owner or Manager may remove a staff member's access at any time; access is revoked immediately. Removing someone does not delete their personal ogMenu account, only their access to that specific Store.

Account Termination We may suspend or terminate accounts that violate these Terms, are used fraudulently, or misuse the Platform. Upon termination, access to the Website and any associated Store data is terminated, subject to our data-retention obligations described in the Privacy Policy.

Stores & Menus

Store Owners and Managers are solely responsible for the accuracy of everything they publish about their Store: name, description, menu items, prices, images, dietary/allergen information, and stock levels. The Platform does not review or verify menu content before it becomes visible to Customers.

A Store may restrict which menu items are available at which Location types (e.g. bar-only items), and may enable or disable pickup and/or delivery fulfillment. Customers see only what the Store has published and enabled at the moment they order.

Alcohol Where a Store lists alcoholic drinks, the Store is solely responsible for verifying the Customer meets the legal drinking age in that jurisdiction before serving - in person, at the time of service, the same as any in-venue alcohol sale. The Platform performs no age verification at checkout, and Store Owners must not enable alcohol sales at a Location where staff cannot verify age before handing over the drink.

Customer Orders

Customers place Orders by scanning a Location's QR code and selecting items from that Store's published menu. An ogMenu account is not required to place an Order.

The Platform is a Technology Provider The contract for the sale of food and drink is between the Customer and the Store - PISHYS SERV is not the seller, does not prepare or handle food, and is not responsible for food quality, safety, allergen accuracy, or timely fulfillment. Those are the Store's sole responsibility.

Order Acceptance An Order is not guaranteed until the Store accepts it. A Store may reject an Order (for example if an item is unexpectedly unavailable), in which case the Customer is refunded in full.

Disputes About Food or Service Any dispute about food quality, order accuracy, or service should be raised directly with the Store. PISHYS SERV is not a party to that dispute, though we may assist in good faith via the Contact page.

Right to Cancel Under EU consumer law, online purchases normally come with a statutory right to cancel within 14 days. That right does not apply here: food and drink prepared for immediate consumption or rapid deterioration is exempted as perishable goods. Once a Store accepts an Order, it cannot be cancelled by the Customer - if something goes wrong, contact the Store directly, or raise it with us via the Contact page if the Store is unresponsive.

Payments & Platform Fees

Customer payments are processed via Stripe and paid out directly to the Store's own Connected Account - PISHYS SERV does not hold or take custody of Customer funds at any point.

Platform Fee A platform fee (currently a small percentage plus a flat amount per Order, shown on request) is deducted automatically from each paid Order before payout to the Store. Store creation itself is free.

Refunds A Store's Owner or Manager can issue a refund for an Order through the Platform. Refunds are returned to the Customer via Stripe, and the Platform fee for that Order is returned to the Store along with it - the Store is never left worse off than what it actually received.

Onboarding Requirement A Store cannot accept paid Orders until its Owner completes Stripe's own account verification (identity, business, and bank details), which happens entirely on Stripe's site and is never seen or stored by PISHYS SERV.

Payment Processing via Stripe

All card and payment-account data is collected and processed directly by Stripe, Inc. and its affiliates ("Stripe"), our payment processing partner. PISHYS SERV never receives, transmits, or stores full card numbers, and does not have access to the bank details Store Owners provide to Stripe during onboarding.

By using the Platform to pay or receive payments, you also agree to Stripe's own terms of service and privacy policy. We're not responsible for outages, delays, or restrictions imposed by Stripe that are outside our control.

Store Owners are responsible for keeping their Connected Account information (business details, bank account, tax status) accurate and up to date directly with Stripe.

Store Owner Responsibilities

By operating a Store on the Platform, Store Owners agree to:

  • Hold all licenses, permits, and registrations required to legally sell food and drink in their jurisdiction.
  • Comply with applicable food safety, hygiene, allergen-labeling, and consumer protection laws.
  • Keep menu prices, availability, and descriptions accurate and current.
  • Fulfil accepted Orders in a reasonable time.
  • Only grant staff the level of access (Manager or Staff) appropriate to that person's role.

Food safety, licensing, and regulatory compliance are entirely the Store's responsibility - the Platform provides the ordering and payment technology, not the food.

Prohibited Conduct

When using the Website, you may not:

  • Impersonate another person, business, or Store, or misrepresent your affiliation with one.
  • Interfere with or disrupt the Website, its APIs, or the networks connected to it.
  • Attempt to place fraudulent Orders or payments, or abuse the refund process.
  • Collect or harvest other users' personal information without consent.
  • Upload menu content, images, or descriptions that are unlawful, misleading, or infringe a third party's rights.

We may suspend or terminate accounts, remove content, or report violations to the relevant authorities in response to a breach of this section.

Intellectual Property

Platform Content The Website's own content, features, and functionality (excluding Store-uploaded content) are the property of PISHYS SERV or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Store Content Store Owners retain ownership of the menu names, descriptions, and images they upload ("Store Content"). By uploading Store Content, you grant PISHYS SERV a worldwide, royalty-free license to host, display, and reproduce it as needed to operate the Store's public menu and QR pages.

Trademarks "ogMenu" and associated logos are trademarks of PISHYS SERV. You may not use them without our prior written consent.

Disclaimer of Warranties

The Website is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

PISHYS SERV does not warrant that the Website will be uninterrupted, error-free, or fully secure, and does not warrant the accuracy of any Store's menu, pricing, or availability information.

We don't guarantee the availability, accuracy, or performance of third-party services we rely on, including Stripe and AWS, and are not liable for outages or failures on their part.

Limitation of Liability

To the fullest extent permitted by law, PISHYS SERV shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the Website, including but not limited to food quality, order fulfillment delays, or payment processing issues caused by a third-party provider.

Where liability cannot be excluded, PISHYS SERV's total liability to you for all claims arising from the Website shall not exceed the total Platform fees collected from the Store or Order giving rise to the claim in the preceding 12 months.

Indemnification

You agree to indemnify and hold harmless PISHYS SERV, its affiliates, officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from: your use or misuse of the Website; your violation of these Terms; a Store's food, service, or regulatory compliance failures; or your violation of any third party's rights.

Suspension & Termination

We may suspend or terminate any account or Store at our discretion, with or without notice, for violating these Terms, fraudulent or unlawful activity, or misuse of the Website. Store Owners may close their own account at any time via the Account page.

Terminating an account does not affect Orders already placed, or the Store's obligations to Customers for those Orders.

Governing Law

These Terms are governed by the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be brought exclusively in the courts of the Republic of Cyprus.

Severability

If any provision of these Terms is found unlawful or unenforceable, that provision is severed and the remaining provisions remain in full force and effect.

Changes to Terms

We may update these Terms from time to time; changes take effect immediately upon posting. Continued use of the Website after a change constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
